摘要：随着全球经济的发展，职业病已成为国际关注的焦点。目前我国国务院法制办公室正在向全社会征集关于修改《中华人民共和国职业病防治法》中有关职业病诊断鉴定的相关建议，德国是职业病保障方面成果比较显著的国家之一，德国藉以其正当合理的职业病诊断认定程序实现患者利益最大化的核心价值诉求，始终坚持公平、正义的保障职业病患者利益最大化。因此本文通过对德国职业病诊断认定程序分析，引发完善我国职业病诊断鉴定程序的思考，藉以实现《职业病防治法》患者利益最大化的核心价值诉求。

 Abstract:With the development of global economy, occupational disease has become the focus of the public. Nowadays, our State Council is calling on the public for advise of Occupational Disease Prevention Law, Germany is one of the country remarkable achievements in security of occupational disease. Germany always insists on the benefits of suffers maximizing with it’s reasonable procedures of diagnosis and identification of occupational disease.
